TRADEMARK COUNSEL FOR SOFTWARE COMPANIES

Seth Yurdin has practiced intellectual property law since 1997 and has worked with technology companies since 2000, through each wave of technology development — from the early internet through SaaS and AI-driven products. He has served as attorney of record on more than 350 USPTO trademark applications, resulting in over 200 registrations, for clients in data security, financial technology, HR technology, health technology, video games, and consumer software.

You work directly with him on every matter.

Why software trademark work is different

Trademark strategy for a software product follows the business, not the technology. A data security platform, an HR tool, and a consumer app face different crowded fields, different classification questions, and different risks. Getting the identification of goods and services right — precise enough to be enforceable, broad enough to cover where the product is going — requires understanding what the product actually does.

Naming a product?

The software and AI naming space is crowded. A name that would have cleared easily three years ago may not today, and AI-formative names increasingly draw descriptiveness refusals.

We start with a knockout search and a realistic assessment of risk — before you commit to a name, build the brand around it, or ship. If the name is viable, we prepare and file the application: identifications drafted for how software is actually delivered — downloadable, SaaS, API, or all three — and coverage planned for the roadmap, not just the current release.

Searches and applications are handled on a flat-fee basis, quoted before any work begins.

Received an office action?

If the USPTO has refused or questioned your application, send it to us. We'll tell you what the examiner is requiring, what your options are, and what a response would cost. Read more about office action responses →

Already have a portfolio?

We manage trademark portfolios end to end: monitoring for conflicting filings, renewals and maintenance, cease and desist matters, and disputes from first demand through resolution. For clients expanding abroad, we file internationally through the Madrid system and work with trusted foreign counsel.

Representative matters

Software and technology clients have included an enterprise data protection company (multi-class portfolio, house mark and product marks), an AI workforce automation platform (registrations covering software using artificial intelligence, with the AI technology described in the identification itself), a financial technology LLM provider, a video game studio (company mark plus multiple game titles), and an employment search platform (substantive refusals overcome).
